A legal disclaimer

The Customer is deemed to have exclusively accepted and is immediately bound by these terms and conditions upon placing an order or accepting delivery of Goods.These terms and conditions may only be amended with Creative Outdoor Pots' written consent and shall prevail in the event of any inconsistency with any other document, correspondence, or agreement between the Customer and Creative Outdoor Pots.

Installation Guideline

Once the pots (Goods) are delivered, the plastic wrapping must be removed to prevent damage to the painted finish. The wrapping is intended to protect the pots during storage and transport.

Creative Outdoor Pots may come with pre-drilled drainage holes or may require drilling to ensure proper water flow. Check that the holes are clear before planting. Place a layer of fibreglass flyscreen over the bottom of the pot, covering the drainage holes to contain large soil particles. Avoid using geo-fabric or similar materials as they can clog.

Fill the pot with high-quality, free-draining potting mix. Avoid regular soil as it retains excess water, which can harm the plant and damage the pot’s exterior. Ensure the pot is elevated to allow proper drainage, even on permeable surfaces like decking or turf. Pot feet or plastic window packers, available from most hardware stores are ideal for this.

Failure to follow these guidelines can lead to structural damage to the pot. The Customer is responsible for installation and use, and Creative Outdoor Pots is not liable for improper installation or use.

Any modifications, such as blocking drainage holes, drilling, painting, or using geo-fabric, will void the warranty. Additionally, the pots are not designed to be directly connected to drainage systems or PVC pipes. Doing so will also void the warranty.

Delivery

At Creative Outdoor Pots' sole discretion, the cost of Delivery is either included in the price or charged separately. The Customer must accept Delivery by receipt or collection of the Goods whenever they are offered for Delivery. If the Customer is unable to accept Delivery as arranged, Creative Outdoor Pots reserves the right to charge a 25% restocking fee, and return delivery fees will also apply.

Creative Outdoor Pots delivers to the kerb only and does not offer unwrapping, placement of the Goods, or moving goods through the property (e.g., up stairs).

The Goods will be packaged and dispatched in a way that ensures safe transit, which may include being delivered on a pallet. Creative Outdoor Pots does not remove any packaging (including pallets) from the delivery site; disposal and removal of packaging are the Customer’s responsibility and expense.

If the Customer arranges their own transportation for Delivery, Creative Outdoor Pots is not liable for any claims related to defects or damages to the Goods during transit.

Delivery of the Goods is deemed to occur when:

  • The Customer or their nominated carrier delivers the Goods to the Customer’s address, or

  • Creative Outdoor Pots (or its nominated carrier) delivers the Goods to the Customer’s nominated address, even if the Customer is not present at the time.

Payment

Full payment for goods is required prior to delivery and is due within 14 days from the invoice date. This invoice is valid for payment and acceptance for 14 days from issuance, after which it may be subject to review and adjustment. Invoices issued during sale periods are valid only for the duration of the sale and must be paid within 24 hours.
